'Tis fashionable to pick on policy-making (read: activist) judges. But 'tis decisions, like this Kansas one, that make one realize why this practice is so prevalent and satisfying. Perhaps smoking crack cocaine is a regular habit of certain gonzo federal judges who make it up as they go along.
